Terms & Conditions
In these Terms Conditions, these terms have the following meanings;
Australian Consumer Law means Schedule 2 to the Competition and Consumer Act 2010 (Cth);
Competition means “Win a Law Squared Entrepreneur Start-up Kit”;
Competition Period has the meaning given to that term in clause 4;
Draw means the prize-draw conducted to determine the Winner;
Draw Date means 10 July 2017;
Draw Details has the meaning given to it in clause 9(a);
Draw Method means barrel draw;
Draw Time means 12pm;
Entrant means a person who enters the Competition in accordance with the Entry Procedure;
Entry Procedure has the meaning given to it in clause 6(a);
Head Office means Level 13, 114 William Street Melbourne VIC 3000;
Immediate Families means spouse, parent, natural or adopted child and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the director, manager, employee, officer or contractor;
Ineligible Entrant means:
(a) directors, management, employees, officers and contractors of the Promoter;
(b) the Immediate Families of directors, management, employees, officers and contractors of the Promoter;
(c) the Promoter’s Related Bodies Corporate;
(d) agencies, companies or other entities associated in any way with the conduct of the Competition;
(e) a client of the Promoter; and
(f) a person or organisation who was a client of the Promoter any time during the 12-months prior to the commencement of the Competition Period;
Maximum Number of Entries means one entry per Entrant;
Prize means one Law Squared Entrepreneur Start-up Kit, which includes:
(c) Website Disclaimer (valued at $300);
(d) Privacy Collection Statement (valued at $350); and
(e) Founders’ Agreement (valued at $1800);
Prize Claim Date means 17 July 2017;
Prize Restrictions means the following:
(a) the Prize cannot be transferred or assigned to a third-party; and
(b) the Prize cannot be redeemed for cash;
Promoter means ZDD Pty Ltd t/as Law Squared ACN 605 466 617 of Level 13, 114 William Street Melbourne VIC 3000 (Ph 03 0998 5954), its directors, employees, contractors and agents and its Related Bodies Corporate (Law Squared);
Related Bodies Corporate has the meaning given to it in the Corporations Act 2001 (Cth);
Survey means Startup Legal Survey;
Terms and Conditions means the terms and conditions outlined in this document;
Total Prize Pool has the meaning given to it in clause 12.1(d);
Verification Requirements has the meaning given to it in clause 11;
Website means www.lawsquared.co; and
Winner means the Entrant whose entry is randomly drawn from the pool of entries of the Competition in accordance with the Draw Details.
In these Terms and Conditions:
(a) if a word or phrase is defined, its other grammatical forms have a corresponding meaning;
(b) all dates and times are fixed by reference to Melbourne, Victoria, Australia; and
(c) all monetary amounts are expressed in Australian Dollars ($AUD).
By entering the Competition, the Entrant is taken to have accepted these Terms and Conditions.
4. Competition Period
The Competition will commence at 9am on 1 June 2017 and end at 11:59pm on 9 July 2017 (Competition Period).
A person is eligible to enter the Competition if the person is:
(a) a resident of Australia;
(b) over the age of 18 at the end of the Competition Period; and
(c) not an Ineligible Entrant.
(a) To enter the Competition, Entrants must:
(i) complete and submit the Survey during the Competition Period;
(ii) provide a valid email address; and
(iii) comply with these Terms and Conditions,
(collectively, Entry Procedure).
(b) Computer generated or other automated entries will not be accepted.
(c) Entries cannot be altered or deleted once submitted.
(d) All entries are the property of the Promoter and will not be returned.
(e) Entrants may enter the Competition up to the Maximum Number of Entries.
(f) All entries must be received by the Promoter during the Competition Period.
(g) The time of entry is deemed to be the time the entry is received by the Promoter.
7. Entry Content
(a) The Entrant is responsible for the content of their entry.
(b) The Entrant must ensure:
(i) their entry complies with these Terms and Conditions; and
(ii) the content of their entry is accurate, complete and contains current information.
(c) The Promoter may, in its absolute discretion, edit, modify, delete or remove entries it determines to be:
(i) incomplete; or
(ii) in breach of these Terms and Conditions.
8. Disqualifying Entrant
The Promoter may, at its sole discretion, determine an Entrant’s entry invalid or disqualify the Entrant from participating in the Competition, if the Entrant:
(a) does not comply with the Entry Procedure;
(b) does not comply with the Verification Requirements;
(c) engages in conduct likely to jeopardise the fair and proper conduct of the Competition; or
(d) engages in conduct which the Promoter determines is fraudulent, misleading, deceptive, damaging to the goodwill or reputation of the Promoter or its services, is contrary to law or is otherwise inappropriate.
(a) The Draw will be conducted by an authorised representative of the Promoter:
(i) on the Draw Date;
(ii) at the Draw Time;
(iii) at the Head Office; and
(iv) by the Draw Method,
(together, Draw Details).
(b) Subject to these Terms and Conditions:
(i) there will be one (1) Draw; and
(ii) the result of the Draw is final.
10. Notification of Winners
The Promoter will:
(a) notify the Winner of the outcome of the Competition within two (2) calendar days of the Draw Date by email; and
(b) advertise the names of any Winner of a Draw of the Competition on the Website within seven (7) calendar days of the Draw Date.
11. Verification requirements
(a) At the Promoter’s request, an Entrant must provide the Promoter or its agent proof of identity, age and residency as part of the entry verification or prize claim process (Verification Requirements).
(b) If an Entrant fails to comply with the Verification Requirements to the Promoter’s satisfaction, the Entrant’s entry will be invalid and the Entrant will be disqualified from the Competition.
(a) Subject to these Terms and Conditions, the Winner will be awarded the Prize.
(b) There is one Prize to be won.
(c) The Prize is subject to the Prize Restrictions.
(d) The Total Prize Pool is $3,550.
(e) The Promoter may in its absolute discretion refuse to award the Winner the Prize if the Winner fails to comply with these Terms and Conditions.
12.2 Claiming Prize
(a) To claim the Prize, the Winner must email the Promoter at email@example.com to schedule a time and date for a meeting with a Law Squared lawyer (Meeting).
(b) The Meeting can be face-to-face or by electronic medium.
(c) The Prize must be claimed by the Prize Claim Date.
12.3 Delivery of Prize
The Prize will be delivered to the Winner within ten (10) business days of the Meeting.
(a) If the Prize is not accepted or claimed by the Prize Claim Date, the Promoter will retain the Prize for a minimum of three (3) months from the Draw Date.
(i) the Prize remains unclaimed for more than three (3) months from the Draw Date;
(ii) the Winner forfeits the Prize; or
(iii) the Winner is disqualified in accordance with these Terms and Conditions,
the Promoter will conduct a further draw seven (7) days from the data an event referred to in clause 13(b) occurs (Re-Draw).
(c) These Terms and Conditions, including clause 13(b), will apply to a Re-Draw.
14. Promotional Material
(a) By entering the Competition, the Entrant agrees to receive promotional material and marketing communications from the Promoter.
(b) The Entrant can opt out from receiving promotional material and marketing communications from the Promoter by emailing firstname.lastname@example.org
(a) In conducting the Competition, the Promoter will collect Entrants’ personal information.
(b) Individuals who do not provide the requisite personal information cannot enter the Competition.
(c) Personal information collected by the Promoter will be:
(i) used by the Promoter to invite Entrants to events and seminars, to develop consumer insights and for the Promoter’s current and future marketing purposes; and
(ii) disclosed to the Promoter’s business partners, related entities, professional advisers, third party service providers, government agencies and regulatory authorities and if required or permitted by law.
(d) The Promoter will collect, use, disclose and store Entrants’ personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
16. Limitation of Liability
(a) Subject to clause 16(b), the Promote is not liable:
(i) for any late, lost, incomplete, incorrectly submitted, delayed, misdirected entries or for any entries that are otherwise not received by the Promoter;
(ii) for any failure to perform or delay in performance of its obligations under these terms and conditions, to the extent that the failure or delay is caused by an act, omissions, event or circumstance outside of the reasonable control of Assembly Label; or
(iii) for any loss, damage or injury suffered by the Entrant arising out of or in connection with this Competition.
(b) Nothing in this clause intends to limit or exclude a Winner’s rights under any law, including the Australian Consumer Law.
17. Tax implications
The Promoter accepts no responsibility for any tax implications that may arise from winning the Prize. Independent financial advice should be obtained before accepting the Prize.
18. Variation of terms
Subject to any applicable law and the approval of the relevant authorities, the Promoter reserves the right to amend, modify, suspend or cancel the Competition.
